Make sure your trial attorney has actually had a trial. Many lawyers hold themselves out to be “trial attorneys,” in one way or another. Some make the claim that they are not afraid to take your case to trial; others say that they have what it takes to win your case; still others directly call themselves “trial lawyers.” Really, it is quite simple: an attorney is not a trial attorney if they have not tried a civil or criminal case in front of a judge or jury.  Just because an attorney says they are not scared of a courtroom, or claims they have the ability to produce success there, does not mean that the lawyer has, in fact, handled a trial.

Ask the attorney you are interviewing how many cases they have tried and, maybe more importantly, how many trials they have won. Because, if the lawyer is not a true trial attorney, what does the insurance company have to fear in playing hardball with your claim?

Is an ultra-aggressive attorney who promises to settle your case quickly really want you want? Barring exceptional circumstances, an auto accident, workers’ compensation or personal injury claim should not be resolved until the injured person has fully recovered from their injuries or reached maximum medical improvement (they are as good as they are going to get). One of the most important factors when evaluating a claim for settlement is to have a full appreciation for what the future holds, or may hold, for the injured person.

Otherwise, if the claim is resolved when there are unknowns pertaining to potential future symptoms, functional deficits and/or medical treatment, the settlement amount will not fully compensate the injured person for the effects the accident has had, and will have, on their life. So, if a lawyer promises you a quick or expedited resolution of your case, is this really the best thing for you and your family?
